I can confirm this bug.

The behavior is not random.  It seems that compiz catches events in the couple
of pixels on the right and left side of the screen which partially covers up
the panel.  To get the panel to pop-up you have to move the mouse back out a
few pixels.  Then it will pop-up consistently.  Still a problem though.
